Form I-765 is used for an initial Employment Authorization Document, a renewal or a replacement. The filing type and eligibility category determine the evidence, fee treatment, possible automatic extension and processing-time selection.

Initial EAD, renewal and replacement are different filings
An initial EAD is the first employment authorization requested in an eligibility category. A renewal asks USCIS for another validity period. A replacement addresses a lost, stolen, damaged card or a card containing an error.
The category entered on Form I-765 matters. It determines the supporting evidence, fee treatment, possible automatic extension and which processing-time selection applies. The category printed on an old EAD is useful evidence, but the current Form I-765 instructions govern.
Automatic EAD extensions: what must be true
An automatic extension is not available to every person who files a renewal. The category must be eligible, the renewal generally must be timely filed, and the category on the receipt must satisfy USCIS matching rules.
Use the USCIS automatic-extension page and the Form I-797 receipt notice together. A pending renewal is not, by itself, proof of continuing work authorization.
How to check an EAD case without overreading status codes
- Enter the receipt number in USCIS Case Status Online.
- Check the Documents and Notices areas in myUSCIS, if the case is linked to an account.
- Treat an official notice, approval document or mailed card as controlling.
- Do not treat community interpretations of hidden event codes as a USCIS decision.
Processing time and when to inquire
USCIS processing times for Form I-765 vary by eligibility category and office. Select the form, category and office from the receipt notice. The tool then shows an estimated range and a case-inquiry date.
The inquiry date is the useful threshold. It tells you when USCIS considers the case outside normal processing time. It does not predict the approval date of an individual application.

Frequently asked questions
Which edition of Form I-765 should I use?
Use the edition USCIS lists as accepted for your postmark or electronic filing date. Confirm the edition on the official Form I-765 page immediately before submitting because USCIS can change accepted editions.
Is an EAD the same as immigration status?
No. An Employment Authorization Document shows work authorization for a stated validity period and category. It does not by itself grant or extend the underlying immigration status.
Does every EAD renewal receive an automatic extension?
No. Eligibility depends on the renewal category, timely filing and other USCIS requirements. Applicants should check the current USCIS automatic-extension page for their category and receipt notice.
How do I check my EAD application status?
Use the USCIS Case Status Online tool with the receipt number from Form I-797. A myUSCIS account can provide notices and history, but unpublished backend event codes are not official decisions.
Can I work while Form I-765 is pending?
A pending I-765 alone does not authorize employment. Work is permitted only when another authorization applies, such as an unexpired EAD or a qualifying automatic extension.
When can I make a USCIS processing-time inquiry?
Select Form I-765, the eligibility category and the office shown on the receipt in the USCIS processing-times tool. USCIS displays the date when a case inquiry can be submitted; the general range is not an individual deadline.
