Why the top category still queues for India

EB-1 receives 28.6 percent of the worldwide employment-based limit plus any numbers the fourth and fifth preferences leave unused. EB-1 is Current for most countries. Why does my Indian case have a cut-off?

Chargeability follows country of birth, and Indian-born demand in EB-1 exceeds India's per-country share. Current in the worldwide column describes everyone outside the listed countries; the India column is the one that governs an Indian-born case regardless of citizenship or residence.

Would my spouse's birthplace help my EB-1 case?

Possibly. Cross-chargeability lets a principal applicant use a spouse's country of birth where that is more favorable. It is a settled doctrine with specific mechanics, worth exact advice from counsel rather than a chart reading.
