One category, four allocations

EB-5 receives 7.1 percent of the worldwide employment limit, and by statute 32 percent of it is reserved: 20 percent for rural investments, 10 percent for high-unemployment areas, and 2 percent for infrastructure projects. The remaining 68 percent is the unreserved pool that most pre-2022 cases and most Indian demand sit in.

The set-asides have their own rows and their own availability, which is how the bulletin can print a U for India's unreserved line in the same month the rural and high-unemployment rows read Current. For a new investor the difference between those rows is the difference between joining a closed queue and an open one.

Common questions

The unreserved row shows U for India but the set-asides show C. How can both be true?

They are separate allocations by statute. The reserved pools are newer and carry far less accumulated demand, so they have stayed open while the unreserved pool's per-country share for India exhausts. Which pool a case belongs to is fixed by the investment's category, and the rows never mix.

Does a U in EB-5 unreserved affect a pending set-aside case?

No. Each row's availability is its own. A set-aside case reads the set-aside row, and the unreserved row's exhaustion neither blocks nor slows it.
